1M Suit Against Cebu Pacific

A 1M suit was filed against Cebu Pacific by a lawyer for not waking him up for his flight.

The case was filed in Manila RTC by Atty. Berteni "Toto" Cataluna Causing, the author of the book "Simplified Libel Law in the Philippines". According to the Atty. Causing, he was supposed to fly to General Santos City on a 5:20 AM Cebu Pacific flight. However, even though he checked in as early as 3:30 AM, he fell asleep at the boarding area for his flight, which was at Gate No. 134. The staff of Cebu Pacific failed to wake him up, only resorting to announcing his name over their PA system to call for boarding. Since he is asleep, he failed to board the plane, causing him to miss his flight and the hearing he was supposed to attend in GenSan.

I like flying with Cebu Pac and I used to believe that I won't be left behind as long as I've checked in. Apparently, this is not the case. The staff of Cebu Pacific won't bother to wake you up even though you're at the area near the boarding gate. I find this ridiculous; shouldn't the airline staff look for that missing person since the name was already checked in at the counter? What's more appalling is that nobody thought that the sleeping person in that particular waiting area is the one who's name is being called for final boarding.

For reference, here is the link for the terms and conditions of carriage of Cebu Pacific. The No-Show Clause (10.3.1) states that: 

"Should the Passenger fail to show up at the check-in counters or at the boarding gate within the prescribed period or board the aircraft at the appointed boarding time, the Airline will offload his Baggage and proceed with the flight without him and without incurring any liability to him."
